BOARD OF TRUSTEES MEETING

​August 22, 2016

​ The Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Chairperson Russell Holly called the meeting to order at 10:00 a.m. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Chairperson Russell Holly, Vice Chairperson Chris Seddelmeyer, Trustee Dave Belton, Fiscal Officer Stephanie Hoffer, Police Chief Mike Keith, Cemetery Advisory Board Pres. Joe Hicks, Road Supt. Howard Gray, and Fire Chief Todd Truesdale. Zoning Inspector Mark Bishop and Legal Advisor Clay Balyeat were absent.

​APPROVAL OF THE MINUTES Mrs. Seddelmeyer motioned for approval of the Minutes of the Regular Board of Trustees Meeting held August 8, 2016, Mr. Belton seconded, and the motion carried 3-0.

​ FISCAL OFFICER’S REPORT Financial report for July 2016 was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Belton seconded and the motion carried 3-0.
​     1. Fund balances and appropriations are in good status, other than line items for health insurance. A Resolution is ready for adjusting those items. 2. The line item for Other Professional & Technical in the Fire Dept. is to be adjusted at next meeting.

​LEGAL ADVISOR
​ No Report

​ Privilege of the Floor: Cub Scouts, Pack #777

​As one of their projects, the Cub Scouts, Pack #777 attended this evening’s meeting. The scouts addressed the trustees with the following questions: 1. Why wasn’t the bike path extended on Ft. Amanda Rd.? Answer: Trustees are looking into extending more bike paths to connect neighborhoods. 2. What are some of the biggest problems in the community? Answer: At this time of year, there are a lot of problems getting vacant properties mowed. 3. How do Townships have enough money to pay bills? Answer: Township Government is supported through local tax levies. 4. What persons make up Township Government? Answer: The Board of Trustees is the legislative body and the Law Director is the judicial body.

​TRUSTEES BUSINESS:

​Resolution # 62-16       FMLA-Jake Breitigan
​BE IT RESOLVED that the Shawnee Township Board of Trustees authorizes Dispatcher Jake Breitigan to begin Family Medical Leave on August 29, 2016 in accordance with the Family Medical Leave Act. ​ Resolution # 63-16       Amend Appropriations
​BE IT RESOLVED that the Shawnee Township Board of Trustees approves amending permanent appropriations as follows: 2021-330-221-0000 Medical, Hospital/Dispatch Increase $ 2,500; 2021-330-323-0000 Repairs & Maintenance Decrease $ 2,500; 2031-330-221-0000 Medical, Hospital Increase $ 4,000; 2031-760-740-0000 Machinery/Equipment Decrease $ 4,000 ;2081-210-221-0000 Medical, Hospital/Dispatch Increase $ 7,000 ;2081-210-231-2100 Worker’s Comp/Dispatch Decrease $ 1,780; 2081-210-231-0000 Worker’s Comp/Police Decrease $ 5,220; 2111-220-221-0000 Medical, Hospital Increase $ 12,000 ;2111-220-231-0000 Worker’s Comp Decrease $ 12,000. ​Resolution # 64-16      Declaration of Public Nuisance and Ordering Abatement for Grass Violations
​ WHEREAS Ohio Revised Code Section 505.87 declares that a Board of Township Trustees may provide for the abatement, control, or removal of vegetation, garbage, refuse, and other debris from land in the township, if the board determines that the owner's maintenance of that vegetation, garbage, refuse, or other debris constitutes a nuisance. WHEREAS Uncontrolled vegetation and/or refuse and debris that constitute a nuisance were reported at the properties listed below in accordance with ORC 505.87. Notices were sent certified mail with return receipt to the owners of the properties as indicated by the Allen County Treasurer’s Office. Joseph and Lynette Harnishferger 1345 Forest Drive Lima, Ohio 45805 L35-46-1804-04-005.000 WHEREAS the Ohio Revised Code Section 505.87 provides that, at least seven days prior to providing for the abatement, control or removal of any vegetation, garbage, refuse or debris, the Board of Trustees shall notify the owner of the land and any holders of liens of record upon the land; and, WHEREAS Ohio Revised Code Section 505.87 provides that, if the Board of Trustee determines within twelve consecutive months after a prior nuisance determination that the same owner’s maintenance of vegetation, garbage refuse, or other debris on the same land in the Township constitutes a nuisance, at least four days prior to providing for the abatement, control or removal of the nuisance, the Board must send notice of the subsequent nuisance determination to the landowner and to any lienholders of record by first class mail; and, WHEREAS In accordance with Ohio Revised Code Section 505.87, the Township Trustees have the authority to contract to abate the nuisances and have the costs incurred assessed to the property tax bill; and, WHEREAS July 12, 2016 – Notice was sent certified mail to Joseph & Lynette Harnishferger, 1345 Forest Drive, Lima, Ohio concerning violation of 505.87 – Abatement, Control, or Removal of Vegetation, Garbage, Refuse, and Debris and violation of 5579.05-Notice to Destroy Noxious Weeds. Whereas, an inspection conducted on July 12, 2016 at 2:08 PM found grass in front, and side yards in excess of 8 inches in height; and rear yard grass was in excess of 12 inches in height. There also were various noxious weeds growing in front, side and rear yard such as wild thistle, wild carrot, and other weeds, briers and vegetation. Notice to correct this violation was to be completed on/before July 25, 2016. Said Certified Mail was returned as Undeliverable to Shawnee Township on 7/31/2016. Violation was not corrected as of August 1, 2016 re-inspection, and; WHEREAS August 3rd, 2016 – A second notice of violation was sent to landowners, Joseph and Lynette Harnishferger, 1345 Forest Drive, Lima, Ohio concerning the non-compliance to control of uncontrolled vegetation as a result of the August 1st inspection. Notice of violation was posted on the front door of the residence with date and time photograph recorded. Violation was to be corrected by August 15, 2016. As of August 17, 2016 the violation was not corrected. THEREFORE BE IT RESOLVED (1) That the Board specifically finds and hereby determines that the uncontrolled growth of vegetation and/or the refuse and debris on each of the said properties listed above constitutes a nuisance within the meaning of Ohio Revised Code Section 505.87, and the Board Directs that notice of this action be given to owners of the said property and lienholders in the manner required by Ohio Revised Code Section 505.87; and (2) That the Shawnee Township Board of Trustees hereby orders the owners of said property to remove and abate the nuisances within seven days after notice of this order is given to the owners and lienholders of record, and within four days after notice of this order is given to the owners and lienholders of record for properties previously determined to be a nuisance. If said nuisances are not removed and abated by the said owners, or if no agreement for removal and abatement is reached between the Township and the owners and lienholders of record within four or seven days after notice is given, Shawnee Township shall cause the nuisances to be removed, and the Township shall notify the County Auditor to assess such costs plus administrative expenses to the property tax bills for the said parcel, as provided in Ohio Revised Code Section 505.87. Mrs. Seddelmeyer motioned for approval of Resolution 64-16, Mr. Belton seconded, and the motion carried 3-0. ​Resolution # 65-16       Accepting the Amounts and Rates as Determined by the Budget Commission and Authorizing the Necessary Tax Levies and Certifying them to the County Auditor
