BOARD OF TRUSTEES MEETING June 27, 2016

​ The Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Chairperson Russ Holly called the meeting to order at 10:00 a.m. A brief moment of silence was followed by the Pledge of Allegiance.

​ Roll call indicated those present as follows: Chairperson Russ Holly, Vice Chairperson Chris Seddelmeyer, Fiscal Officer Stephanie Hoffer, Police Chief Mike Keith, Fire Chief Todd Truesdale, Road Supt. Howard Gray, Shawnee Twp. Cemetery Advisory Board Pres. Joe Hicks, Legal Advisor Clay Balyeat, and Zoning Inspector Mark Bishop. Trustee Dave Belton was absent.

​APPROVAL OF THE MINUTES
​Mrs. Seddelmeyer motioned for approval of the Minutes of the Regular Board of Trustees Meeting held June 13, 2016, Mr. Holly seconded, and the motion carried 2-0.

​ Resolution 37-16       Reallocate Wages-Jacob Breitigan
​     Whereas, Jacob Breitigan employment status as Dispatcher for Shawnee Township changed from part-time Dispatcher to full-time Dispatcher effective May 22, 2016; Whereas, best efforts are made to make sure dispatch wages are allocated evenly or appropriately among departments, therefore be it hereby resolved, with the change to full-time status, Jacob’s wages and benefits will be reallocated to the Fire Dept. ​ Resolution 38-16     Effective Date for Seasonal Employee’s Wage Increases
​     Whereas, the Shawnee Township Board of Trustee approved wage increases for Seasonal Employees in Resolutions 33-16 through 35-16 for the following employees: John Miller new wage rate/per hr. $10.00 Jake Thomas new wage rate/per hr. $10.00 Taylor Lucas new wage rate/per hr. $10.50 Jordan Tovarnak new wage rate/per hr. $10.00 Be it hereby resolved, the effective date of the above wage increases are effective of the seasonal employee’s hire date for summer help in 2016. ​ Resolution 39-16      Declaration of Nuisance/Order of Abatement
​     WHERAS, the Ohio Revised Code, sect. 505.86 (Removal, Repair or Securance of Insecure, Unsafe Buildings or Structures) denotes that the Board of Township Trustees may provide for the removal, repair, or securance of buildings or other structures in the township that have been declared insecure, unsafe, or structurally defective by any fire department under contract with the township or by the county building department or other authority responsible under Chapter 3781. of the Revised Code for the enforcement of building regulations or the performance of building inspections in the township, or buildings or other structures that have been declared unfit for human habitation by the board of health of the general health district of which the township is a part. WHEREAS, on May 28, 2015 Ms. Juanita Savage aka Juanita Price, of 2187 Augusta Drive, Lima, Ohio owner of a residential home and detached garage located at 950 Bradford Avenue, Lima, Ohio (Tax Parcel: L35 46-0206-04-008.000) voluntarily sought and was granted a demolition permit (2015-4928) for the purpose of demolishing the residential structure as well as detached garage by a private contractor. WHEREAS, a complaint was filed over the conditions left of the vacant land parcel by the contractor. It was determined that the detached single car garage was not removed during the demolition process. In addition, tires, carpeting, metal, and other scrap and debris from the demolition remained at the site. In investigating the incident several photographs were taken showing the conditions of the site as well as the detached garage which was structurally unsound, the roof was open to elements, and posed a risk to health and safety of others. WHEREAS, on May 3, 2016 a Notice of Zoning Violation as well as photographs taken on March 25, 2016, and April 29, 2016 and was sent to Ms. Juanita Savage, 2187 Augusta Drive, Lima, Ohio placing her on notice of the alleged violations of Shawnee Township Zoning Regulations 1704-Uses Not Permitted and 1704.9-Dumping, Storing, Burying, Landfilling, Reducing, Disposing, or burning garbage, refuse scrap metal, rubbish, used timber, and rubber, offal or dead animals, except as a result from normal use of premises, unless such disposal is done at a place and manner provided by the Township Trustees for such a purpose. On May 22, 2016 said letter was returned back to Shawnee Township as unclaimed certified mail. WHEREAS, on June 22, 2016 the Shawnee Township Fire Chief conducted an inspection of the parcel located at 950 Bradford Avenue. The detached garage structure was determined to be unsafe and a no entry order was made for fire personnel. The adjacent grounds was littered with debris from previous demolition. WHEREAS, the property remains a Public Nuisance, a safety risk, and a health hazard, and under the powers of the Ohio Revised Code section 505.86 for the Removal, repair or securance of unsafe buildings or structures; the Board of Trustees hereby order the structure removed and declare it an emergency; WHEREAS, at least thirty days prior to the removal, repair, or securance of any insecure, unsafe, or structurally defective building, the board of township trustees shall give intention with respect to the removal, repair, or securance to the holders of legal or equitable liens of record upon the real property on which the building is located and to owners of record of the property. The owner's address is unknown and cannot reasonably be obtained; therefore the notice is being published once in a newspaper of general circulation in the township in accordance with ORC 505.86. All costs incurred in the demolition process including any administrative fees shall be assessed onto the property tax bill. FURTHER BE IT RESOLVED, the Shawnee Township Board of Trustees in accordance with ORC 505.86 Section (B) have determined an emergency exists in the deteriorated conditions of the structure on the property where fire, safety and health risks are present, and therefore the Board of Trustees orders notification to be posted on the structure in lieu of certified mail; as well as the notice is being published once in a newspaper of general circulation in the township in accordance with ORC 505.86. In accordance with the ORC 505.86 Section (B), the structure located at 950 Bradford Avenue, Lima, Ohio is ordered by the Board of Trustees to be demolished after 30 days from the date of this Resolution, being on or thereafter July 30, 2016. This order shall be conveyed to any future property owner and of lien holders from this day forward. In accordance with the ORC 505.86 Section C (1) order the Shawnee Township Fiscal Officer to certify the total cost of the demolition, removal of debris, and administrative costs to the Allen County Auditor to be placed upon the tax duplicate. ​Resolution 40-16      Declaration of Public Nuisance and Ordering Abatement
​     WHEREAS, Ohio Revised Code Section 505.87 declares that a Board of Township Trustees may provide for the abatement, control, or removal of vegetation, garbage, refuse, and other debris from land in the township, if the board determines that the owner's maintenance of that vegetation, garbage, refuse, or other debris constitutes a nuisance. WHEREAS, Uncontrolled vegetation and/or refuse and debris that constitute a nuisance were reported at the properties listed below in accordance with ORC 505.87. Notices were sent certified mail with return receipt to the owners of the properties as indicated by the Allen County Treasurer’s Office. Not corrected as of 6/24/2016 WHEREAS, the Ohio Revised Code Section 505.87 provides that, at least seven days prior to providing for the abatement, control or removal of any vegetation, garbage, refuse or debris, the Board of Trustees shall notify the owner of the land and any holders of liens of record upon the land; and, WHEREAS, Ohio Revised Code Section 505.87 provides that, if the Board of Trustee determines within twelve consecutive months after a prior nuisance determination that the same owner’s maintenance of vegetation, garbage refuse, or other debris on the same land in the Township constitutes a nuisance, at least four days prior to providing for the abatement, control or removal of the nuisance, the Board must send notice of the subsequent nuisance determination to the landowner and to any lienholders of record by first class mail; and, WHEREAS, In accordance with Ohio Revised Code Section 505.87, the Township Trustees have the authority to contract to abate the nuisances and have the costs incurred assessed to the property tax bill; and, THEREFORE BE IT RESOLVED, (1) That the Board specifically finds and hereby determines that the uncontrolled growth of vegetation and/or the refuse and debris on each of the said properties listed above constitutes a nuisance within the meaning of Ohio Revised Code Section 505.87, and the Board Directs that notice of this action be given to owners of the said property and lienholders in the manner required by Ohio Revised Code Section 505.87; and (2) That the Shawnee Township Board of Trustees hereby orders the owners of said property to remove and abate the nuisances within seven days after notice of this order is given to the owners and lienholders of record, and within four days after notice of this order is given to the owners and lienholders of record for properties previously determined to be a nuisance. If said nuisances are not removed and abated by the said owners, or if no agreement for removal and abatement is reached between the Township and the owners and lienholders of record within four or seven days after notice is given, Shawnee Township shall cause the nuisances to be removed, and the Township shall notify the County Auditor to assess such costs plus administrative expenses to the property tax bills for the said parcel, as provided in Ohio Revised Code Section 505.87. ​      Be it resolved, the Shawnee Township Board of Trustees hereby authorizes Family Medical Leave to Theresa Paxson for the period beginning June 15, 2016, and ending on June 26, 2016, in accordance with the Family Medical Leave Act.
