BOARD OF TRUSTEES MEETING
May 9, 2016

The Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Vice Chairperson Chris Seddelmeyer called the meeting to order at 7:00 p.m. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Vice Chairperson Chris Seddelmeyer, Trustee Dave Belton, Fiscal Officer Stephanie Hoffer, Police Chief Mike Keith, Fire Chief Todd Truesdale, Cemetery Advisory Board Pres. Joe Hicks, Road Supt. Howard Gray, Legal Advisor Clay Balyeat, and Zoning Inspector Mark Bishop. Chairperson Russ Holly was absent.

APPROVAL OF THE MINUTES
Mr. Belton motioned for approval of the Minutes of the Regular Board of Trustees Meeting held April 25, 2016, Mrs. Seddelmeyer seconded, and the motion carried 2-0.

FISCAL OFFICER’S REPORT

LEGAL ADVISOR
Discussion:
     • Douglas Fay Construction

Privilege of the Floor Mike and Beth Steiger-3310 Muirfield Drive
      
     Mr. Steiger addressed the Board of Trustees stating that once proud of his neighborhood he is now concerned with the deterioration of some of the properties and the effect it will have on other property values. Presenting the board with pictures of concern, a property on Greens with a dilapidating shed and crumbling concrete driveway, mud and leaves blocking a water drain on Pro Drive, and a vacant lot overgrown with weeds, Mike and Beth asked for the Township to enforce codes that would require property owners to clean up unkempt properties, and for the Township to mow the vacant lot overgrown with weeds. Beth stated she had filed a complaint regarding these issues to Zoning Inspector Mark Bishop, but felt Mark dismissed her concerns and the problems went unresolved. The Board explained that the Township is limited as to what they can do in regards to private property. As for the leaves, Road Supt. Howard Gray explained property owners are required to rake or bring leaves to side of the road so that the Twp. Road Dept. can pick them up. Legal Advisor Clay Balyeat mentioned the Township can enforce Ohio Revised Code 505.87, Removal of Garbage and Vegetation, if there is a health risk. A complaint must be filed with the Township about the property with overgrown weeds. The Township would give the owner an allotted amount of time to get the property mowed. If unresolved by the property owner, the Township would see that the property is mowed and would assess taxes on the property for the cost of service. Trustees mentioned Homeowners Associations ability to enforce restrictions in neighborhoods and new programs such as the Land Bank Program, still in the working process, that gives administrative power for seizure of abandoned properties.

TRUSTEES BUSINESS:

Resolution # 29-16      Amend Permanent Appropriations

BE IT RESOLVED that the Shawnee Township Board of Trustees approves of the following changes to the Permanent Appropriations of Shawnee Township: Line Item Amount 9002-220-599-0000 Fire Escrow, Increase $5,753.84
Mr. Belton motioned for approval of Resolution 29-16, Mrs. Seddelmeyer seconded, and the motion carried 2-0. Roll Call: Mr. Belton, yes Mr. Holly, absent Mrs. Seddelemeyer, yes

DEPARTMENTAL BUSINESS

Fire Department

The Fire Dept. Activity Report for April 2016 as submitted by Fire Chief Truesdale was reviewed by the Board. Mr. Belton motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried. (Report attached) Discussion: • 126 calls for the month. 80% EMS. Busy. • Manikins donated for training. Thank you to Dr. Recker • Supreme Court ruling in regards to e-mails. (Public Meetings Act) • Fire Extinguisher Inspections

Police Department

The Police Dept. Activity Report for April 2016, as submitted by Police Chief Mike Keith, was reviewed by the Board. Mr. Belton motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried. (Report attached) Discussion: • Accidents are up. • Training hours include new updates this year

Road Department

The Road Dept. Activity Report for April 2016, as submitted by Road Superintendent Howard Gray, was reviewed by the Board. Mr. Belton motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried. (Report attached) Discussion: • Township Clean-Up Day, Sat. May 4th. Dumpsters located at Twp. Road Dept. Parking Lot.

Zoning Department

The Zoning Activity Report for April 2016, as submitted by Zoning Inspector Mark Bishop, was reviewed by the Board. Mr. Belton motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried. (Report attached) Discussion: • 16 permits for construction • 14 complaints filed • Drainage issues, junk vehicles, mowing citations • Application for permit for a new LED Sign for Shawnee United Methodist Church (10’ wide x 6’ tall). Total with base 15ft. tall.

Cemetery

The Cemetery Activity Report for April 2016, as submitted by Cemetery Advisory Board Pres. Joe Hicks, was reviewed by the Board. Mr. Belton motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried. (Report attached) Discussion: • Agreement for new software. Set up meeting with Software Co. • Getting cemetery ready for Memorial Day weekend • Get county to sweep roadways in cemetery • Property owners to clean-up what is over property line

COMMUNICATIONS  1. Township Clean-Up Day, Sat. May 14th 2. Tax Incentive Review Council (TIRC)-Incentives approved  3. Agreement with County for maintenance of Round-a-Bout  4. Ohio Township Association-Senate Bill 235 passed  5. Meeting with Allen County Port Authority-Transmission Line for Windfall turned down

BILLS

Mr. Belton motioned the board approve paying the bills by resolution, Mrs. Seddelmeyer seconded, and the motion carried 2-0. Roll call: Mr. Belton (yes) Mr. Holly (absent) Mrs. Seddelmeyer (yes)
