Minutes of Meeting, Sept. 14, 2015
On Sept. 14, 2015, the Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio.
Chairperson Dave Belton called the meeting to order at 7:00 p.m. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Chairperson Dave Belton, Trustee Chris Seddelmeyer, Vice-Chair Russ Holly, Fiscal Officer Stephanie Hoffer, Road Supt. Howard Gray, Zoning Inspector Mark Bishop, Legal Advisor Clay Balyeat, Police Chief Mike Keith, and Fire Chief Todd Truesdale.
APPROVAL OF THE MINUTES Mrs. Seddelmeyer made a motion to approve the Minutes of the Regular Meeting held August 24, 2015, Mr. Holly seconded, and the motion carried 3-0.
FISCAL OFFICER’S REPORT
Financial Reports for August 2015 were submitted to the Board of Trustees and Departments. Mrs. Seddelmeyer made a motion to approve the financials, Mr. Holly seconded, and the motion carried 3-0.
Discussion: • Fund balances and appropriations are in good status • Budget Hearing with County Auditor went well • Township received TPPT Reimbursements last week
Discussion: • Riverwalk PUD rezoning. File variance with Zoning Board of Appeals SWEARING IN OF: Justin Cloud-Fire Department With his family and friends present, Justin Cloud was sworn in as a Firefighter/Paramedic for the Shawnee Township Fire Dept. by Fire Chief Todd Truesdale.
PRIVILEGE OF THE FLOOR: Dan Henry, 3696 Huntleigh Dr., Lima, Ohio
Mr. Henry addressed the Board of Trustees discussing an issue with two different areas (Struthmore and Breese Rd.), where there were road cuts, stating there are bumps in those areas, and questioned if there were performance bonds issued for those who did the work. Trustees said that one of the roads was a county road, but the other would be addressed. Mr. Henry also mentioned the Shawnee Cemetery had high weeds in areas as of Aug. 10th, and looked bad for the Labor Day Holiday. Trustee Belton explained there were recent changes in management and the Township is now responsible for the cemetery and plan to make sure mowing and all other issues involving the cemetery will be addressed.
PRIVILEGE OF THE FLOOR: Julie Etzkorn, 1658 Pro Drive, Lima, Ohio
Mrs. Etzkorn addressed the Board of Trustees explaining she and her husband purchased their home at 1658 Pro Drive 5 years ago, stating the home has no basement and is not in a flood zone, but was flooded with water twice with the heavy rain back in July. She said 6” of rain creeped into their home within an hour until there was up to 1’ of water in the entire home. She stated some of her neighbors had basements flooded with 19” of water. Her home is at a lower elevation than surrounding properties. Julie provided photos of the flooding inside of her home. Nathan Davis, Assistant Drainage Engineer from the Allen County Engineer’s Office was present. Nathan stated drainage in the area of Pro Dr. has been a problem for some time. With more houses and roads added, the current drainage system is too small to handle all the frequent rain we have had. Nathan recommended that the Township try and cover the cost of replacing the current tiles and basins in that area instead of the project being petitioned, and estimated the cost of installing larger basins and replacing the current tile system using approx.215’ of 18”-22” tile that would be connected to a larger tile system at Ft. Amanda Rd. to be approx. $7,000 to $8,000. Trustee Seddelmeyer asked that County Engineers prepare a plan for the project.
Resolution # 94-15 Acceptance of Phase I for Applewood Subdivision (Amended)
NOW THEREFORE BE IT RESOLVED that the Shawnee Township Board of Trustees hereby accepts Phase 1 of Applewood Subdivision as presented by land owner Ted Spieles.
FURTHER the acceptance of the project is without the requirement of the walking path around the pond, but will however have to conform to the Allen County Storm Water and Sediment regulations as attached hereto. Amended: Further, the Shawnee Township Board of Trustees waives the roadway bond as the roadway has been upgraded to County Sepcifications, and has been in service for approximately year. Resolution # 101-15 Authorization to Participate in Recertification of EMD for Dispatchers through PowerPhone
BE IT RESOLVED, the Shawnee Township Board of Trustees hereby authorizes participation in Emergency Medical Dispatch (EMD) certification through PowerPhone, Madison, Connecticut at a cost not to exceed $1,600.00. FURTHER, the Board authorizes the $44.85 annual maintenance fee, after the first 12 months, for the maint3enance and licensing updates on the two (2) protocol tablets included in the certification for a total of $89.70 annually. Resolution # 102-15 FMLA-T. Hackworth
BE IT RESOLVED, the Shawnee Township Board of Trustees authorizes Police Officer Travis Hackworth to begin Family Medical Leave on Sept. 10, 205, in accordance with the Family Medical Leave Act. Resolution #103-15 Declaration of Public Nuisance and Ordering Abatement
Whereas, Uncontrolled vegetation and/or refuse and debris were reported at the properties listed below: Tax Parcel # L3546-2308-010.000, Address: 4175 S. Dixie Hwy. Owner of Record: YOUNG BEVERLY J & BARBARA J BOOKHART 4175 S DIXIE HWY LIMA, OHIO 45806 Whereas, the Ohio Revised Code Section 505.87 provides that at least seven days prior to providing for the abatement, control, or removal of any vegetation, garbage, refuse or debris, the Board of Trustees shall notify the owner of the land and any holders of liens of record upon the land; and, Whereas, the Ohio Revised Code, Section 505.87, provides that, if the Board of Trustees determines within twelve consecutive months after a prior nuisance determination that the same owner’s maintenance of vegetation, garbage refuse, or other debris on the same land in the township constitutes a nuisance, at least four days prior to providing for the abatement, control or removal of the nuisance, the Board must send notice of the subsequent nuisance determination to the landowner and to any lien holders of record by first class mail; and, Whereas, in accordance with the Ohio Revised Code, Section 505.87, the Township Trustees have the authority to contract to abate the nuisances and have the costs incurred assessed to the property tax bill; and, Therefore be it hereby resolved, (1) That the Board specifically finds and herby determines that the uncontrolled growth of vegetation and/or the refuse and debris on each of the said properties listed above constitutes a nuisance within the meaning of the Ohio Revised Code Section 505.87, and the Board directs that notice of this action be given to owners of the said property and lien holders in the manner required by Ohio Revised Code Section 505.87; and; (2) That the Shawnee Township Board of Trustees hereby orders the owners of said property to remove and abate the nuisances within seven days after notice of this order is given to the owners and lien holders of record, and within four days after notice of this order is given to the owners and lien holders of record for properties previously determined to be a nuisance. If said nuisances are not removed and abated by the said owners, or if no agreement for removal and abatement is reached between the Township and the owners and lien holders of record within four or seven days after notice is given, Shawnee township shall cause the nuisances to be removed, and the Township shall notify the County Auditor to assess such costs plus administrative expenses to the property tax bills for the said parcel, as provided in Ohio Revised Code Section 505.87. The Monthly Activity Report for August 2015 for the Fire Department as submitted by Fire Chief Truesdale was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried. The report is attached and made part of these minutes.
Discussion: • Number of service calls down from previous month, between 115-120. 70 % of calls were EMS. • Chief Truesdale to attend Shawnee School s Administration Roundtable Meeting • Fire Vehicles are able to get through new Round-a-Bout. Regular traffic in round-a-bout is to take quickest exit if an emergency vehicle running its siren enters round-a-bout.
The Monthly Activity Report for August 2015 for the Police Department as submitted by Police Chief Keith was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried. The report is attached and made part of these minutes.

The Monthly Activity Report for August 2015 for the Road Department as submitted by Road Supt. Gray was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried. The report is attached and made part of these minutes.
Discussion: • Labor hours spent on brush pick-up • Salt Prices this year $60.63 per ton, $44.62 less than last year. (Lawsuit filed in 2012 with Attorney General. Re: Alleged conspiracy between Morton & Cargill Salt causing Local Governments to pay higher prices for road salt in 2008-2010. No recent communications from Attorney General concerning settlement)
The Monthly Zoning Report for August 2015 as submitted by Zoning Inspector Mark Bishop was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried. The report is attached and made part of these minutes.

The Monthly Activity Report for the Shawnee Township Cemetery, as submitted by Joe Hicks, Pres. of Cemetery Advisory Board, was reviewed by Shawnee Township Board of Trustees. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded and the motion carried. The Monthly Activity Report and Minutes of Cemetery Advisory Board held July 17, 2015 are attached and made part of these minutes.
