On June 22, 2015, the Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Chairperson Dave Belton called the meeting to order at 10:00a.m. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Chairperson Dave Belton, Trustee Chris Seddelmeyer, Vice-Chair Russ Holly, Fiscal Officer Stephanie Hoffer, Police Chief Mike Keith, Road Supt. Howard Gray and Zoning Inspector Mark Bishop. Legal Advisor Clay Balyeat arrived at 10:15am and Fire Chief Todd Truesdale arrived at 10:25am.
APPROVAL OF THE MINUTES Mrs. Seddelmeyer made a motion to approve the Minutes of the Regular Meeting held June 8, 2015, Mr. Holly seconded, and the motion carried 3-0.
FISCAL OFFICER’S REPORT
Financial Reports for May 2015 were submitted to the Board of Trustees and Departments. Mrs. Seddelmeyer made a motion to approve the financials, Mr. Holly seconded, motion carried 3-0.
Discussion: • Fund balances and appropriations are good status. • Received Rollback & Homestead • Public Notice was placed in the Lima News on June 19 for Budget Hearing • Resolution 68-15: Increase Appropriations in the Fire Dept. to purchase new cutters from Howell Rescue ($13,450)
Discussion: • Privilege of the Floor: Harry Baber, 3301 S. Dixie Hwy., Lima, OH 45804 Mr. Baber was not present at this evening’s meeting but the letter he presented to the Township Trustees in regards to a water drainage issue on his property was read by Mr. Belton. (Letter attached) Discussion: 1. Pond on neighbor’s property. 2. Neighbor, Tom Stewart in violation of zoning regulations per Attorney Clay Balyeat. (Mound and flow of water) 3. Enforce Zoning-Twp. Zoning Inspector to send letter to Mr. Stewart notifying him that he is in violation of Twp. Zoning Regulations and that he has 30 days from the date of letter to comply.
Resolution # 67-15 Resolution of Necessity for Levying Tax Exceeding Ten-Mill Limitation
WHEREAS, the Shawnee Township Board of Trustees have determined that the amount of taxes which may be raised within the ten mill limitation will be insufficient to provide an adequate amount for the necessary current expenses of the Shawnee Township Police Department; and, WHEREAS, a resolution declaring the necessity of levying a tax under the Ohio Revised Code 5705.03 outside the ten-mill limitation must be passed and certified to the Allen County Auditor in order to permit the Board of Trustees of Shawnee Township, Allen County, Ohio to consider the levy of such tax and must request that the county auditor certify to the Board of Trustees of Shawnee Township the total current tax valuation of Shawnee Township Police District, Allen County, Ohio and the dollar amount of revenue that would be generated by the tax; THEREFORE, be it hereby resolved by the Shawnee Township Board of Trustees two-thirds of all members elected thereto concurring, that it is necessary to levy the renewal of an existing two (2.0) mill 5-yr. renewal levy, for the purpose of generating funds to pay the necessary current expenses of the Shawnee Township Police District; which rate is the same as the rate currently in place for said renewal as provided in Revised Code 5705.03, at a rate not exceeding two (2.0)mills for each one dollar of valuation, which amounts to .20 cents ($0.20) for each one hundred dollars ($100.00) of valuation for a period of five (5) years beginning with tax year 2015 and ending in with 2020; and further RESOLVED, that the levy be placed upon the tax lists of the current year commencing January 1, 2015, first due in the calendar year 2016, in compliance with the Ohio Revised Code Section 5705.34 if a majority of the electors voting thereon in favor thereof; and RESOLVED, that the question of such tax levy would then be submitted to the electors of Shawnee Township, Allen County, Ohio, at the election to be held therein on November 3, 2015; and RESOLVED, that the Fiscal Officer is hereby directed to certify a copy of the resolution to the Allen County Auditor and the Board of Elections, Allen County, Ohio. The Board of Trustees of Shawnee Township, Allen County, Ohio, hereby requests that the Allen County Auditor certify to this Board the total current tax valuation of the Shawnee Township Police District, Allen County, Ohio, and the dollar amount of revenue that would be generated by (2.0) mills if approved by the electors. Shawnee Township Board of Trustees finds and determines that all formal actions relative to the passage of this resolution were taken in an open meeting and that all deliberations of the Trustees which resulted in the passage of this Resolution were taken in meetings open to the public, in full compliance with all the legal requirements including Section 121.22 of the Ohio Revised Code. Resolution # 68-15 Amend Appropriations-Fire Dept.
Be it hereby Resolved, the Shawnee Township Board of Trustees approves of increasing current appropriations for the Fire Dept. as follows: Machinery, Equipment, & Furniture (2111-760-740-0000) Increase $13,450.00 And further, approves of the purchase a C160 & 140 Cutter from Howell Rescue for the Fire Dept. effective 6/10/2015. Resolution # 69-15 Amend Current Appropriations
Be it hereby Resolved, the Shawnee Township Board of Trustees approves of amending current appropriations as follows: 2021-330-323-0000 Repairs & Maintenance Decrease $200,000.00 2021-330-420-0000 Operating Decrease $ 90,000.00 (Budget for carry-over-2016 Gas Tax Fund) 2031-760-740-0000 Machinery & Equipment Decrease $ 70,000.00 (Budget for carry-over -2016 Road & Bridge Fund) A motion by Mrs. Seddelmeyer to approve Resolution #69-15 was seconded by Mr. Holly, and the motion carried 3-0. Resolution # 70-15 Acceptance of Delta Dental for Employee Dental Benefits
Be it hereby Resolved, that the Shawnee Township Board of Trustees herby accepts the recommendation of the Insurance Committee to accept Delta Dental as the Employee Dental Benefits. Further, the contract with Delta Dental shall be a one (1) year contract and shall be effective July 1, 2015 continuing through June 30, 2016 as attached here to. (July 1st Rates: Single $28.90, Family $87.06) A motion by Mrs. Seddelmeyer to approve Resolution #70-15 was seconded by Mr. Holly, and the motion carried 3-0. Resolution # 71-15 Authorization for Attorney Clay Balyeat to Proceed with Court Filings on 1408 Southwood Dr.
BE IT RESOLVED, that the Shawnee Township Board of Trustees hereby authorizes Attorney Clay Balyeat to initiate filing with the Allen County Court of Common Pleas, Civil Division for proceedings against the owner, William Patrick Altenbach, of the property at 1408 Southwood Drive as a public nuisance and request demolition to the structure thereupon. Resolution # 72-15 Appointment of Department Heads
BE IT RESOLVED, that the Shawnee Township Board of Trustees hereby appoints the primary Trustee Department Heads for July 1, 2015 through June 30, 2016 as follows: Trustee Belton – Fire and Cemetery Trustee Holly – Roads and Zoning Trustee Seddelmeyer – Police and Dispatch A motion by Mrs. Seddelmeyer to approve Resolution #72-15 was seconded by Mr. Holly, and the motion carried 3-0. Resolution # 73-15 FMLA-James Jordan
Be it hereby resolved, the Shawnee Township Board of Trustees authorizes Road Dept. Worker James Jordan to begin Family Medical Leave on June 25, 2015 in accordance with the Family Medical Leave Act.
