April 27, 2015

On April 27, 2015, the Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Chairperson Dave Belton called the meeting to order at 10:00AM. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Chairperson Dave Belton, Vice-Chair Russ Holly, Trustee Chris Seddelmeyer, Fiscal Officer Stephanie Hoffer, Zoning Inspector Mark Bishop, Legal Advisor Clay Balyeat, Fire Chief Todd Truesdale, and Road Supt. Howard Gray. Police Chief Mike Keith, was absent.

APPROVAL OF THE MINUTES

Mrs. Seddelmeyer made a motion to approve the Minutes of the Regular Board Meeting held April 13, 2015, Mr. Holly seconded, and the motion carried 3-0.

FISCAL OFFICER’S REPORT

Discussion: • Request reimbursement from the Ohio Road Development Grant for work done so far by LJB on the Fort Shawnee Industrial Dr. Project. • Brandy Reed from State Auditor’s Office is to do final audit of Shawnee Cemetery’s accounts. • Pepsi-Cola Co. to begin full vending service of the smaller pop machine at Adm. Bldg., and to remove the larger machine.

  LEGAL ADVISOR

Discussion:

• 1408 Southwood Drive o Clay had nothing to report in regards to 1408 Southwood Dr.

• Pothole on Zurmehly Rd. o Person claiming vehicle damaged due to pothole on Zurmehly Rd. Clay Balyeat contacted complainant who informed him that she had called the Shawnee Township Garage after the incident and that someone from the garage told her that the Township would take care of the damage. Clay said the Township may be responsible, but was still concerned about the complainant’s burden of proof and no police report.

• Greens Rd. o Motion for Default Judgement Entry. In mid-March a notice was sent through ordinary mail to available service address. Demolition may begin and junk vehicles may be removed 28 days after serving notice.

• Shawnee Twp. Cemetery o Original property deed lists past Township Trustees as owners of the Shawnee Cemetery. Clay said no new deed is required. o Cemetery Committee Member Joe Hicks informed Township Trustees that the sewer line project behind the cemetery is taking up more burial land than what was proposed by the Sanitary Engineer Officials. He explained a lot of trees were cut down and the cemetery would be losing valuable space. Items to be researched are compromise of property, legal description of the property, the plat, fair market value of property, loss of property, and the temporary and permanent easement.

• Privilege of the Floor o Harry Baber, 3301 S. Dixie Hwy., Lima, Ohio 45806. 

Mr. Baber said something needs done about the mud and water draining onto his drive and yard from the hill along the side of his property. The hill was created when his neighbor built a pond and there is no grass planted or landscaping to avoid the runoff from the hill. Mr. Bacon’s office surveyed Mr. Baber’s property and is to record the survey.  Trustee Holly mentioned the responsibility of having a storm water permit. Mr. Balyeat referred to the Township Zoning Text and Changing of Direction of Water Flow on Property.

TRUSTEES BUSINESS      

Resolution # 37-15       Acceptance of the 2015 Township Road Program

BE IT RESOLVED, the Shawnee Township Board of Trustees accepts the 2015 Shawnee Township Road Program as attached hereto. A motion by Mrs. Seddelmeyer to approve Resolution #37-15 was seconded by Mr. Holly, and the motion carried 3-0. Roll Call: Mr. Belton, yes Mr. Holly, Yes Mrs. Seddelmeyer, yes

Resolution # 38-15      Accept Resignation of Todd Barnhill

BE IT RESOLVED, the Shawnee Township Board of Trustees hereby accepts Todd Barnhill’s resignation as a Police Officer for the Shawnee Township Police Dept., effective April 15, 2015. FURTHER, the Board of Trustees wishes to thank Mr. Barnhill for his years of service and dedication to the department. Resolution # 39-15       Increase in Appropriations

BE IT RESOLVED, the Shawnee Township Board of Trustees approves of the following Then & Now Transactions and the reallocation funds in line items for the expense. Resolution # 41-15      Ending FMLA- Matt Myers

Whereas, the Shawnee Township Board of Trustees passed Resolution 36-15 on April 13, 2015, authorizing Firefighter/Paramedic Matthew Myers to begin Family Medical Leave on April 12, 2015 in accordance with the Family Medical Leave Act, and; Whereas, Mr. Myers returned to full duty on April 29, 2015, and; Now therefore be it resolved, the Shawnee Township Board of Trustees hereby ends Matt Myers’ Family Medical Leave, effective April 29, 2015. Resolution # 42-15       Hiring of Full-time Police Officer - Cory Wilson

Now Therefore Be it resolved, the Shawnee Township Board of Trustees authorizes the hiring of Cory Wilson as a full-time Police Officer effective May 4, 2015, with benefits in accordance with the Union Contract between the Shawnee Township Board of Trustees and FOP/OLC Patrolman’s Unit. # 43-15      Authorization for Allen County Engineer to Develop a Plan for Shawnee Road Widening

Now therefore be it resolved, the Shawnee Tonwship Board of Trustees hereby authorizes the Allen County Engineer to develop a plan to widen Shawnee Road, beginning south of the current roundabout/widening project, continuing south to Zurmehly Rd. Resolution # 44-15       Authorization to Hire Kenneth Armentrout as Part-time Cemetery Superintendent

Now therefore be it resolved, the Shawnee Township Board of Trustees hereby authorizes hiring Kenneth Armentrout as the Part-time Cemetery Superintendent for the Shawnee Township Cemetery. Further, Mr. Armentrout’s wage shall be set at $15.00 per hour, not to exceed 28 hours per week. Mr. Armentrout’s position shall fall under the guidelines, rule, regulations, and benefits of the Shawnee Township Personnel Policy and Procedure Manual. Resolution # 45-15      Authorization to Advertise for Part-time Seasonal Labor

Resolution # 46-15       Appointment of Cemetery Directors

Whereas, in accordance with the Ohio Revised Code, Section 517.20, the Board of Township Trustees may appoint three directors to take charge of any cemetery in the Township, and; Therefore, the Shawnee Township board of Trustees hereby appoints the following directors and terms to oversee the Shawnee Township Cemetery: Herb Shaw May 12, 2015 through May 12, 2016 Don Binkley May 12, 2015through May 12, 2017 Joe Hicks May 12, 2015 through May 12, 2018 Further, Joe Hicks shall serve as Chairman through his term. Resolution # 47-15       Authorization to Hire Ron Parr as Part-time Project Manager to Oversee the Ft. Shawnee Industrial Drive Project

Be it resolved, the Shawnee Township Board of Trustees hereby authorizes the hiring of Ronald Parr as Part-time Project Manager to oversee the Ft. Shawnee Industrial Dr. Project. Further, Mr. Parr’s wage shall be set at $26.00 per hour, and this position shall be effective from April 27, 2015 through the approved completion of the project. Resolution # 48-15      Authorization to Make “Fitness Standard” Available to Part-time Patrol Officers and Dispatchers

Be it Resolved, the Shawnee Township Board of Trustees hereby makes the “Fitness Standard” as accepted by the Sergeants and Dispatch Units of the FOP/OLC, available to the Part-time Patrol Officers and Dispatchers. A motion by Mrs. Seddelmeyer to approve Resolution #48-15 was seconded by Mr. Holly, and the motion carried 3-0. Roll Call: Mr. Belton, yes Mr. Holly, Yes Mrs. Seddelmeyer, yes A motion by Mr. Holly to Amend the Agenda to include Resolution #49-15 was seconded by Mrs. Seddelmeyer. Motion carried 3-0.

Resolution # 49-15       Award Contract for the Fort Shawnee Industrial Rd. Phase II Project to RD Jones Excavating, Inc.

Whereas, the Shawnee Township Board of Trustees posted Legal Notice in the Lima News on April 7, 2015 for accepting Sealed Bids for the Fort Shawnee Industrial Drive Phase II Road Project; and; Whereas, the Legal Notice gave instruction as to: 1. Receiving Sealed Bids 5. Each Bidder 2. Scope of Work 6. Each Proposal 3. Improvement 7. Bidders 4. Plans, Specifications and Contract Documents 8. Bids Whereas, the Shawnee Township Board of Trustees, Allen County, Ohio received Sealed Bids for the project until 9:30 AM (local time) on Tuesday, April 21, 2015, and at that time bids were opened and read aloud. No action was taken. Bids received were as follows: RD Jones Excavating, Inc.; Hume Supply Inc.; RB Jergens; JDR Excavating Inc,; and The Beaver Excavating Company. The lowest bidder was RD Jones Excavating, Inc. at $822,706.58. Whereas, LJP, Inc., reported RD Jones Excavating has successfully completed projects in the region in the past five years, has good references to projects of similar size and scope of work, and further recommended the Shawnee Township Board of Trustees award the contract to RD Jones Excavating. Therefore be it hereby resolved, the Shawnee Township Board of Trustees accepts the bid of $822,706.58 from RD Jones Excavating for the Fort Shawnee Industrial Rd. Phase II Project. A motion by Mrs. Seddelmeyer to approve Resolution #49-15 was seconded by Mr. Holly, and the motion carried 3-0. Roll Call: Mr. Belton, yes Mr. Holly, Yes Mrs. Seddelmeyer, yes Mr. Belton reported that the Fort Industrial Drive Phase II Project was made possible through an Ohio Development Services Grant that will reimburse the Township for 2/3 of the cost of the project, up to $900,000. Project completion date is scheduled for 2016. A reconstruction hearing is scheduled for 2:00pm, Tues, Apr. 28th with LBJ, Inc. and RD Jones Excavating. Mr. Holly mentioned the new road will give access for emergency vehicles. The curbs and gutters, privately owned, will create great aesthetics for the area designed for businesses.

DEPARTMENTAL BUSINESS

Fire Department

Discussion: • HB64-Communications with Senator Faber o Fire Dept. budget would be cut by $560,000 per yr. if they lose TPPT Reimbursements as stated in HB64. Funding could only be recovered with new levy. (2.5 to recover loss) Current fire levies go back to 1980.  Dept. has increased firefighters per shift and increased training  Good ISO Ratings have reduced insurance premiums for homeowner’s and businesses  400 Townships will be affected by this loss  Chief Truesdale to testify in May • Tanker-Medic X o Fire extinguisher needs replaced due to corrosion from road salt • Lima Memorial Hospital o Use of Lucas II Device for cardiac arrest patient

Police Department

  Discussion: • Bomb threat at Shawnee School o School Officials followed procedure o Sniff dogs were used to clear areas and students were placed in safe area o Police trained to handle situation and did a good job addressing situation o No bombs were found o Lima Senior High recently had two bomb threats

Road Department

The Monthly Activity Report for March 2015, as submitted by Road Superintendent Howard Gray, was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried 3-0. The report is attached and made part of these minutes.
