Minutes of Meeting, April 13, 2015

April 13, 2015

On April 13, 2015, the Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Chairperson Dave Belton called the meeting to order at 7:00PM. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Chairperson Dave Belton, Trustee Chris Seddelmeyer, Vice-Chair Russ Holly, Fiscal Officer Stephanie Hoffer, Police Chief Mike Keith, Zoning Inspector Mark Bishop, Legal Advisor Clay Balyeat, and Fire Chief Todd Truesdale. Road Supt. Howard Gray was absent.

APPROVAL OF THE MINUTES

Mrs. Seddelmeyer made a motion to approve the Minutes of the Regular Board Meeting held March 9, 2015, Mr. Belton seconded, and the motion carried 2-0. Mrs. Seddelmeyer made a motion to approve the Minutes of the Regular Board Meeting held March 23, 2015, Mr. Holly seconded, and the motion carried 3-0.

FISCAL OFFICER’S REPORT

Financial Reports for March 2015 were reviewed by the Board of Trustees and Departments. Mr. Holly made a motion to approve the financials, Mrs. Seddelmeyer seconded, and the motion carried 3-0.

Discussion:

• Appropriations are in good status other than EMS salary line items. Appropriations need increased for those items, and total appropriations for the EMS Fund needs increased to better reflect the total resources available for that fund. • Township received 1st half RE Tax Settlement. • Payment made to LJB: $13,085.

  LEGAL ADVISOR

Discussion:

  • Pothole on Zurmehly Rd. o Person claiming vehicle damaged due to pothole on Zurmehly Rd.-Clay Balyeat to contact complainant. o Did Twp. have knowledge of pothole? (Liability?) o Complainant has burden of proof. • Greens Rd. o Clay to submit notice to available service address. Demolition may begin and junk vehicles may be removed 28 days after serving notice. • Shawnee Twp. Cemetery o Cemetery Board adopted Resolution 2015-1. Cemetery is not its own entity and the Township Board of Trustees has full control of the cemetery. a. Cemetery Board to serve as advisory committee. b. Cemetery Deed. (Currently belongs to Twp.) c. Twp. Trustees to rehire positions for cemetery. d. Record Cemetery Fund in Township Accounts. e. Cemetery Board deposit to Township Account. • Entering Private Property o Uninhabitable Properties  Clay to find out more information as to the Fire Dept. having authorization to enter and assess uninhabitable structures in case of a fire. (Safety)

• Privilege of the Floor o Harry Baber, 3301 S. Dixie Hwy., Lima, Ohio 45806.  Mr. Baber complained that a dirt hill on his neighbor’s property is encroaching on his property. Township Zoning Inspector Mark Bishop plans to follow up based on applicable zoning regulations and a final survey.

• 1408 Southwood Drive o Board of Health found property unfit and a public nuisance.

TRUSTEES BUSINESS

Resolution # 30-15      Adopt Shawnee Township Cemetery Resolution 2015-1

Whereas, the Shawnee Township Board of Trustees met with the Shawnee Cemetery Board Members on April 13, 2015 at a Special Meeting held by the Cemetery Board for the purpose of adopting Shawnee Township Cemetery Resolution 2015-1; and, Whereas, the purpose of the Cemetery Resolution 2015-1 is (1) for the Shawnee Cemetery to be treated as a component unit of Shawnee Township and a direct division of Shawnee Township, and no longer act as its own entity (2) for the members of the Shawnee Cemetery Board to serve as an Advisory Committee with authority to manage and operate ongoing business of the Cemetery under the instruction and policies set forth by the Shawnee Township Board of Trustees (3) for the Fiscal Officer of Shawnee Township to create a Cemetery Fund in the Shawnee Township Funds for segregating and recording income and expense and the financial activity of the cemetery, within rules set forth by the ORC; and, Whereas, the Township Trustees set forth an effective date of April 20, 2015 for said transition over the Shawnee Township Cemetery, and adopt the attached terms of employment and policies for the Shawnee Township Cemetery; THEREFORE BE IT HEREBY RESOLVED, the Shawnee Township Board of Trustees adopts the attached Shawnee Township Cemetery Resolution 2015-1; A motion by Mrs. Seddelmeyer to approve Resolution #30-15 was seconded by Mr. Holly, and the motion carried 3-0. Resolution # 31-15       Adopt Banking Agreements

BE IT RESOLVED that the Shawnee Township Board of Trustees hereby adopts the attached banking agreements with First Federal Bank, per attached. Resolution # 32-15      Renewal of Contract with JSMC

BE IT RESOLVED, the Shawnee Township Board of Trustees hereby agrees to renew the contract with Joint Systems Manufacturing Center (JSMC) for the Township to provide Ambulatory and Fire Services at JSMC. (Contract Attached) Purchase Order Number: W56HZV-15-P-0231 Contractor: Shawnee Township Program: Fire and Ambulance Services at JSMC Lima Award Date: March 30, 2015 A motion by Mrs. Seddelmeyer to approve Resolution #32-15 was seconded by Mr. Holly, and the motion carried 3-0. Resolution # 34-15      Acceptance of Memorandum of Understanding with FOP/OLC Dispatch Unit

Be it hereby resolved, the Shawnee Township Board of Trustees accepts the Memorandum of Understanding for the Physical Fitness Program with the Dispatchers Unit of FOP/OLC as attached hereto. Resolution # 35-15      Ending FMLA-Connie Miller

Whereas, the Shawnee Township Board of Trustees passed Resolution 29-15 authorizing Full-time Dispatcher Connie Miller to begin Family Medical Leave effective March 30, 2015 and to accumulate per hour as used as per the Family Medical Leave Act regulations, and; Be it hereby resolved, that Mrs. Miller has returned to full duty and the Shawnee Township Board of Trustees hereby ends her FMLA, effective April 8, 2015. Resolution # 36-15      FMLA-Matt Myers

Be it hereby resolved, the Shawnee Township Board of Trustees authorizes Firefighter/Paramedic Matthew Myers to begin Family Medical Leave on April 12, 2015 in accordance with the Family Medical Leave Act. A motion by Mrs. Seddelmeyer to approve Resolution #36-15 was seconded by Mr. Holly, and the motion carried 3-0. Roll Call: Mr. Belton, yes Mr. Holly, Yes Mrs. Seddelmeyer, yes

DEPARTMENTAL BUSINESS

Fire Department

The Monthly Activity Report March 2015 for the Fire Department, as submitted by Fire Chief Truesdale, was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried 3-0. The report is attached and made part of these minutes.

Discussion: • 149 Calls. 72% EMS. • Calls continue to go up each year. Stats: YTD calls for March 2015 is 441. YTD last year was 338. • E-mails sent to Representative Cupp and Senator Faber in reference to HB64. o OTA Updates –State Budget and TPPT Reimbursements (CAT). Chief Truesdale waiting on the House Ways and Means Committee.

  Police Department

The Monthly Activity Report for March 2015 for the Police Department, as submitted by Police Chief Keith, was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried 3-0. The report is attached and made part of these minutes.

Discussion: • Accidents up 23% compared to this time last year. Overall calls down 19%.

Road Department

Discussion: • 2015 Road Program o Price of paving approx. $173,000 o Other costs include drainage issues. o Type of Work (Seal, Sweep, Pave) o Twp. to receive Issue I money for 2016 Road Program. • Round-a-Bout Project at the intersection of Shawnee & Fort Amanda Rd. ahead of schedule • Inspection of Metcalf St. Bridge scheduled

Zoning Department

The Monthly Activity Report for the Zoning Department, as submitted by Zoning Inspector Mark Bishop, was reviewed by the Board. Mrs. Seddelmeyer motioned for approval of the report, Mr. Holly seconded, and the motion carried 3-0. The report is attached and made part of these minutes.

Clay Balyeat referred to Codes 3781 and 3791 in regards to a Zoning Inspector or Fire Chief entering a property considered unsafe or uninhabitable and plans to further research the laws.
