BOARD OF TRUSTEES MEETING November 23, 2015

The Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio.

Chairperson Dave Belton called the meeting to order at 10:03 a.m. A brief moment of silence was followed by the Pledge of Allegiance.

Roll call indicated those present as follows: Chairperson Dave Belton, Trustee Chris Seddelmeyer, Fiscal Officer Stephanie Hoffer, Road Supt. Howard Gray, Police Chief Mike Keith, Fire Chief Todd Truesdale and Cemetery Board Pres. Joe Hicks. Legal Advisor Clay Balyeat, Zoning Inspector Mark Bishop, and Vice Chairperson Russ Holly were absent.

APPROVAL OF THE MINUTES

Mrs. Seddelmeyer made a motion to approve the Minutes of the Regular Meeting held November 9, 2015, Mr. Belton seconded, and the motion carried 2-0.

FISCAL OFFICER’S REPORT

SWEARING IN OF: Jedidiah Walker Jedidiah was sworn in as Part-time Police Officer for Shawnee Township Police Dept. by Police Chief Michael Keith.

TRUSTEES BUSINESS

Resolution # 124-15       Authorization to Hire Jedidiah Walker as Part-time Police Officer

Be it hereby resolved, that the Shawnee Township Board of Trustees hereby authorizes the hiring of Jedidiah Walker as part-time police officer, effective November 23, 2015. A motion by Mrs. Seddelmeyer to approve Resolution #124-15 was seconded by Mr. Belton. Motion carried 2-0. Roll Call: Mr. Belton, yes Mr. Holly, Absent Mrs. Seddelmeyer, Yes

Resolution # 125-15       FMLA-J. Hodges

Be it hereby resolved, that the Shawnee Township Board of Trustees hereby authorizes Firefighter Josh Hodges to begin Family Medical Leave on November 5, 2015 in accordance with the Family Medical Leave Act. Resolution # 126-15      Authorization to Complete Drainage Project on Pro Drive

Be it hereby resolved, that the Shawnee Township Board of Trustees hereby authorizes the completion of the drainage project on Pro Drive as proposed by the Allen County Drainage Engineer at a cost not to exceed $8,000.00. (See attached plans) A motion by Mrs. Seddelmeyer to approve Resolution #126-15 was seconded by Mr. Belton. Motion carried 2-0. Roll Call: Mr. Belton, yes Mr. Holly, Absent Mrs. Seddelmeyer, Yes

Resolution #127-15      Authorization to Advertise for Sealed Bids for the Amblewood Drive Drainage Project

Be it hereby resolved, the Shawnee Township Board of Trustees authorizes the advertising for sealed bids on the Amblewood Drive Drainage project. Resolution #128-15      Acceptance of Shawnee Township Board of Zoning Appeals Recommendations Riverwalk PUD Structural Changes/Set Back Requirement

WHEREAS…On October 20th, 2015 Shawnee Township Board of Zoning Appeals heard a petition for a variance which was submitted by VRW, LLC (The Village at Riverwalk) c/o Mr. O. Roger Wright Land Company LLC. Petitioner requested a change to their existing PUD-Planned Unit Development, for tax map parcel 46-1508-02-010.000 on the north-east side of Zurmehly Road, Lima, Ohio. Changes to the existing PUD included the following: WHEREAS…The owner / developer Roger Wright Land Company, LLC agreed to build new units (individual and quad) pursuant to certain specifications already reviewed and approved by the Board of Directors which occurred on June 4, 2015. WHEREAS…Internal alterations / lay out design of site plans was reviewed and approved by Mr. Matt Huffman, Attorney of Record for O. Roger Wright. Changes consisted of: • All Floor plans will mirror existing construction and be built on slabs or crawl spaces. • External appearances of all new units will be very similar to current VRW units with regard to cement board siding, paint color, color of roof shingles and applied stone facing. • The builder providing landscaping of new units will be similar to existing VRW units. • Permanent road adjoining the new units will be finished with a second coat of asphalt paving. • Existing broken curbing bordering the sites purchased by Mr. Wright will be repaired and returned to original condition. • Upon the completion of all new units, the remnants of the current gravel constructing road leading to newly built units will be removed and grassed. WHEREAS…Mr. Joel Long (Builder) requested an amendment to the variance and requested to include the ability to move the individual units and quad units three-(3) feet in either direction to accommodate a proposed width change to a service drive for emergency vehicles. Amendment was approved by the Zoning Appeals Board. WHEREAS…Based on the evidence presented, and supporting documentation the Shawnee Township Board of Zoning Appeals voted unanimously in favor of approving the variance requests concerning the Riverwalk PUD Revisions as well as granting a variance of 3 feet for the building of single and quad units.. WHEREAS…This matter is brought before the Shawnee Township Board of Trustee for formal review and approval of the recommendations of the Shawnee Township Board of Appeals. Resolution #129-15       Acceptance of Shawnee Township Board of Zoning Appeals Denial Recommendations Thomas J. Stewart, 3265 S. Dixie Hwy., Lima, Ohio Variance – Commercial Building Side Set Back Requirement

WHEREAS…On October 20th, 2015 Shawnee Township Board of Zoning Appeals heard a petition for an area variance which was submitted by Thomas J. Stewart, 3265 S. Dixie Hwy., Lima, Ohio 45804. All members of the Board of Appels were present and accounted for. During this hearing, the Board of Zoning Appels reviewed the Appeal for Area Variance as well as supporting documentation and testimony from T. Stewart, B. Core, D. Younkman (Attorney for H. Baber) and M. Bishop (Zoning Insp.) WHEREAS…On September 4th, 2015 Thomas J. Stewart submitted an application to the Shawnee Township Zoning Inspector for the construction of a permanent accessory structure. Mr. Stewart is identified as Thomas J. Stewart, DBA (Doing Business As) Stewart Construction, 3265 South Dixie Hwy, Lima, Ohio 45804. WHEREAS…Thomas Stewart requested to build a 64 foot x 32 foot (2048 SF) detached structure identified as a “pole barn” on a parcel located at 3275 S. Dixie Hwy., Lima, Ohio. The proposed use has not been determined in the application and zoning process, however later identified as “personal use”. The proposed site for construction of this accessory building was going to be (15)-feet from side property line, belonging to Mr. Harry Baber, 3301 S. Dixie Hwy., Lima, Ohio. In the application, Mr. Stewart indicated the front set back was 268.9 feet from road right of way, and rear set back was 200 feet. South Side Yard Set Back was 15 feet, 0 inches. WHEREAS…The south side set back did not conform to Shawnee Township Zoning Regulation under Article XIX Area and Bulk Requirements, Section 1901-Business, Commercial, Industrial and Manufacturing Districts –Schedule of Regulations. The proposed site of this accessory building is located on a parcel identified as being B-4 (BIV) Commercial Use. The parcel to the south, belonging to Mr. Harry E. & Diane H. Baber is zoned as Residential (R-II-H) use. Side yard setback for commercial structures according to zoning is (15)-fifteen feet. However, when a commercial parcel abuts a residential parcel the side yard setback is (40)-forty feet. Based on lack of site plans for construction, failure to submit a storm water management plan, side set back requirements not met the application was denied and notice given. WHEREAS… The Shawnee Township Board of Appeals heard the testimony of Brad Core, Thomas Stewart, Derek Younkman, and Mark Bishop. Issues on drainage, storm water flow, usable space, alternate methods of placement of structure and the ongoing soil and sediment water issues between Stewart and Baber. The matter came to close after discussions, when Stewart was asked to move the building 90 degrees to meet side set back requirement. Stewart refused to comply with the request, and matter came to vote by the Board of Appeals with Earl Weigt making the motion for denial and second by David Ryan. All members of the appeals board voted no, on passing the variance request. BE IT RESOLVED…The Shawnee Township Board of Zoning Appeals submits to the Shawnee Township Board of Trustees, their recommendation for DENIAL of the variance request submitted by Thomas J. Stewart, 3265 S. Dixie Hwy., Lima, Ohio 45804 Acceptance of Shawnee Township Board of Zoning Appeals Denial Recommendation A motion by Mrs. Seddelmeyer to approve Resolution #129-15 was seconded by Mr. Belton. Resolution #130-15      Acceptance of Insurance Committee Recommendation (2016 Healthcare Insurance Plan)

Be it hereby resolved, the Shawnee Township Board of Trustees accepts the Township’s Health Insurance Committee’s recommendation for group health insurance coverage for 2016 and authorizes continuing health insurance coverage through Ohio Insurance Service Agency, as per the attached agreement. A motion by Mrs. Seddelmeyer to approve Resolution #130-15 was seconded by Mr. Belton. Motion carried 2-0. Roll Call: Mr. Belton, yes Mr. Holly, Absent Mrs. Seddelmeyer, Yes

Discussion: • Fence in wrong spot • Met with Representative Bob Cupp. Letter written requesting change in O.R.C to address the construction of Cemetery Mausoleums • Plans for Veterans Monument (O.R.C. $5,000 max.) • Trent Barnhill doing a great job. Cemetery looks great.
