BOARD OF TRUSTEES MEETING July 28, 2014 On July 28, 2014, the Shawnee Township Board of Trustees met at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Vice Chairman Belton called the meeting to order at 10:00 a.m. Roll call indicated those present as follows: Trustee David Belton, Trustee Russ Holly, Chief Mike Keith, Chief Todd Truesdale, Superintendent Howard Gray, Zoning Inspector Hile and Administrative Assistant Missy Van Meter. Trustee Chris Seddelmeyer, Attorney Clay Balyeat, and Fiscal Officer Stephanie Hoffer were absent. Mr. Holly made a motion for the Board to accept the Minutes of the Regular Meeting of June 23, 2014, Mr. Belton seconded the motion. Motion passed 2-0. Trustee Holly made a motion to accept the July 14, 2014 Minutes of the Regular Meeting. Trustee Belton seconded the motion. Motion passed 2-0. Trustee Holly made a motion to accept the July 14, 2014 Minutes of the Budget Hearing. Trustee Belton seconded the motion. Motion passed 2-0. FISCAL OFFICER: Trustee Holly made a motion to accept the June 2014 Financial Report. Trustee Belton seconded the motion. Motion passed 2-0. NOTE: Discussion over CAT TAX and real estate settlements. LEGAL ADVISOR: TRUSTEES BUSINESS: Chief Keith presented Adam Hoehn with a promotion to Sergeant. With Mr. Hoehn’s family present he accepted the promotion. HEARING ON 3412 GREENS AVE. Bill Kelly of the Allen County Health District attended the hearing to discuss the conditions and findings of the residence at 3412 Greens. Mr. Kelly stated that the conditions of 3412 Greens is unfit for human habitation as declared by the Allen County Health District in a letter on July 11, 2014, the same day as the hearing by the ACHD declaring it unfit. Mr. Kelly stated that the conditions were horrible and that in addition to the conditions, the owner had water services, but had no water usage for over one year. Mr. Kelly has also sent a letter to the owner on July 7, 2014 stating that the home was unfit. Fire Chief Truesdale stated that he sent a letter notifying Ms. Clevenger (owner of record) that the house was unsafe and unsecure and he declared it a “No Entry” structure for fire personnel. The letter was date July 2, 2014. The board and Mr. Kelly discussed the daughter being notified and being more involved in the situation with some guidance from the ACHD and FD, however, it probably would not be something the daughter would be willing to do. There was discussion as to what would happen if Ms. Clevenger would be removed from the house, and it was determined that would have to be done through the Allen County Adult Protection Services. At this point the Township has gone through all the appropriate and necessary actions in accordance with the Ohio Revised Code to declare it a nuisance (June 23, 2014, Resolution 72-14) and have the situation abated. Law Director, Clay Balyeat will draft a letter to the owner, Ms. Clevenger, stating the intentions of the Township to proceed toward abating the property conditions in total, up to and including razing the property. The costs will be assessed to the taxes. The owner had the right to appeal the order of the ACHD through the Allen County Court of Common Pleas, and had not yet done that. Notice will be posted on the structure and there is to be no one occupying or staying at the residence until it is corrected or razed. RESOLUTION 75-14 Authorization for Lump Sum Payment as per FOP/OLC Contract for Full-time Patrolman William “Ben” Altenbach WHEREAS William “Ben” Altenbach was hired as a full-time Patrolman for the Shawnee Township Police Department on June 1, 2014, and; WHEREAS the wage agreement for the FOP/OLC Contract the full-time officers accepted a one-time lump sum payment in lieu of an hourly wage increase, and; NOW THEREFORE BE IT RESOLVED the Shawnee Township Board of Trustees hereby authorizes a one-time lump sum payment to William “Ben” Altenbach in the prorated amount of $437.50. Mr. Holly motioned for approval, Mr. Belton seconded, and the motion carried 2-0. Roll Call: Mr. Belton, Yes Mr. Holly, Yes Mrs. Seddelmeyer, absent RESOLUTION 76-14 Acceptance of Maintenance Agreement with Allen Water District BE IT HEREBY RESOLVED that the Shawnee Township Board of Trustees accepts the Allen Water District Maintenance Agreement as attached hereto. Mr. Holly motioned for approval, Mr. Belton seconded, and the motion carried 2-0. Roll Call: Mr. Belton, Yes Mr. Holly, Yes Mrs. Seddelmeyer, absent RESOLUTION 77-14 Authorization to Construct a Letter of Action for 3412 Green BE IT RESOLVED that the Shawnee Township Board of Trustees hereby authorizes Township Law Director, Clay Balyeat, to draft a letter of action for the property at 3412 Greens, citing the violations and the action that the Township intends to take to resolve the conditions. Mr. Holly motioned for approval, Mr. Belton seconded, and the motion carried 2-0. Trustee Holly seconded the motion and the motion passed 2-0.
