BOARD OF TRUSTEES MEETING June 9, 2014 On June 9, 2014, the Shawnee Township Board of Trustees held a Regular Board Meeting at the Shawnee Township Administration Building, 2530 Fort Amanda Rd., Lima, Ohio. Chairperson Chris Seddelmeyer called the meeting to order at 7:30PM. A brief moment of silence was followed by the Pledge of Allegiance. Roll call indicated those present as follows: Chairperson Chris Seddelmeyer, Trustee Russ Holly, Fire Chief Todd Truesdale, Legal Advisor Clay Balyeat, Fiscal Officer Stephanie Hoffer, Police Chief Mike Keith, Road Supt. Howard Gray, and Zoning Inspector Jim Hile. Dave Belton was absent. APPROVAL OF THE MINUTES Mr. Holly made a motion to approve the Minutes of the Regular Board Meeting held May 12, 2014, Mrs. Seddelmeyer seconded, and the motion carried. Mr. Holly made a motion to approve the Minutes of the Regular Board Meeting held May 27, 2014, Mrs. Seddelmeyer seconded, and the motion carried. FISCAL OFFICER’S REPORT A Budget Hearing will be held at the Twp. Adm. Bldg., July 14, at 7PM, prior to the Regular Board of Trustees Meeting. Stephanie mentioned reducing current appropriations (capital) for efficient carry-overs in 2014 and 2015. There will a notice of the hearing in the Lima News on July 3, 2014. LEGAL ADVISOR • Lease Agreement for Project • Insurance Issues PRIVILEDGE OF THE FLOOR: Cindy Kill-City View Terrace (R. Cotrell) Mrs. Kill informed the Board of Trustees that she and others have formed the City View Terrace Neighborhood Association, which she chairs. She wrote a formal complaint and addressed the Township Trustees of problems the association is having in the neighborhood with go-karts on roads, unleashed dogs, unkempt grass, deteriorating roadways, and dilapidated homes they want to see demolished. She also wanted to know what the association could do to have the neighborhood park that was taken down by the Township, put back. The letter is attached and made part of these minutes. Mrs. Seddelmyer said she was pleased that Cindy and others brought the association together and would see that the Township helps as much as possible. Police Chief Mike Keith said his department would address the go-kart issue. Mr. Holly said that the Dog Warden would need to be contacted to deal with dog issues, and that the trustees will be approving a resolution at tonight’s meeting that will deal with mowing of unkempt grass and removing debris. As for the demolition of deteriorating homes, Mr. Holly explained this is a long process that the Township has been working on and informed Cindy that a few years back the Township tore down a couple of dilapidated homes in that area. Chief Truesdale asked Cindy to let neighbors know that they are not allowed to burn trash in the neighborhood, and that if someone is burning trash, call the Fire Dept. so they can investigate. Road Supt. Gray let Cindy know that tomorrow the Road Dept. will begin working on the potholes in that area. Mrs. Seddelmeyer commented that when the list of issues with the park is addressed, the Board will see what they can do. PRIVILEGE OF THE FLOOR: Tim Mosher, 3009 Pro Dr., Lima, Ohio Mr. Mosher addressed the Board of Trustees asking if his road was part of this year’s Road Program. Road Supt. Gray informed him it was not. Tim explained there were 3 areas of concrete collapsed on his road and said that he would like to see the roadway eventually paved. He asked if there was a way the Township could replace the broken concrete for now. Mr. Holly mentioned looking into the repairs. TRUSTEES BUSINESS: Resolution # 54-14 Hiring of William “Ben” Altenbach as Full-Time Police Officer Be it hereby resolved, the Shawnee Township Board of Trustees authorizes the hiring of William “Ben” Altenbach as a Full-time Police Officer effective June 1, 2014; Further, pay rate and benefits for this position shall be regulated by the FOP/OLC Contract with the Shawnee Township Board of Trustees A motion by Mr. Holly to approve of Resolution #54-14 was seconded by Mrs. Seddelmeyer, and the motion carried 2-0. Roll Call: Mr. Belton, absent Mr. Holly, Yes Mrs. Seddelmeyer, Yes Resolution # 55-14 Promotion of Patrolman Adam Hoehn to Police Sergeant Be it hereby resolved, the Shawnee Township Board of Trustees authorizes the promotion of Patrolman Adam Hoehn to Police Sergeant effective June 1, 2014; Further, pay rate and benefits for this position shall be regulated by the FOP/OLC Contract with the Shawnee Township Board of Trustees. A motion by Mr. Holly to approve of Resolution #55-14 was seconded by Mrs. Seddelmeyer, and the motion carried 2-0. Roll Call: Mr. Belton, absent Mr. Holly, Yes Mrs. Seddelmeyer, Yes Resolution # 56-14 Acceptance of Retirement of Craig Hoffer Be it hereby resolved, the Shawnee Township Board of Trustees hereby accepts the retirement of Sergeant Craig Hoffer effective June 2, 2014; Further, the Shawnee Township Board of Trustees wishes to express their appreciation for Mr. Hoffer’s years of service to the Shawnee Township Police Department. A motion by Mr. Holly to approve of Resolution #56-14 was seconded by Mrs. Seddelmeyer, and the motion carried 2-0. Roll Call: Mr. Belton, absent Mr. Holly, Yes Mrs. Seddelmeyer, Yes Resolution # 57-14 Authorization to Hire Part-time Seasonal Road Worker-Miller Be it hereby resolved, the Shawnee Township Board of Trustees authorizes the hiring of John Miller as a Part-time Seasonal Road Worker effective June 9, 2014 under the direction of the Shawnee Township Board of Trustees and the Road Superintendent; Further, the position shall be an at-will position with a salary of $10.00 per hour and not to exceed 39 hours per week. This position shall be regulated by the Shawnee Township Personnel Policy and Procedure Manual. A motion by Mr. Holly to approve of Resolution #57-14 was seconded by Mrs. Seddelmeyer, and the motion carried 2-0. Hanthorn Rd., Lima, Ohio 45804; Further, the accepted bid shall be at a cost of $83,943.00 for the chassis with the equipment package through Kalida Truck Equipment Inc. at a cost of $53,690.00, for a total delivery cost of $137,633.00, to be paid upon delivery and inspection. A motion by Mr. Holly to approve of Resolution #59-14 was seconded by Mrs. Seddelmeyer, and the motion carried 2-0. Mr. Hasenstaub’s light duty return to work will be under the guidelines and necessities of the Shawnee Township Fire Department overseen by Chief Truesdale and the Board of Trustees. Dixie Tax Parcel # L35 46-1310-01-010.000 WHEREAS the Ohio Revised Code Section 505.87 provides that, at least seven days prior to providing for the abatement, control or removal of any vegetation, garbage, refuse or debris, the Board of Trustees shall notify the owner of the land and any holders of liens of record upon the land; and, WHEREAS Ohio Revised Code Section 505.87 provides that, if the Board of Trustee determines within twelve consecutive months after a prior nuisance determination that the same owner’s maintenance of vegetation, garbage refuse, or other debris on the same land in the township constitutes a nuisance, at least four days prior to providing for the abatement, control or removal of the nuisance, the Board must send notice of the subsequent nuisance determination to the landowner and to any lienholders of record by first class mail; and, WHEREAS In accordance with Ohio Revised Code Section 505.87, the Township Trustees have the authority to contract to abate the nuisances and have the costs incurred assessed to the property tax bill; and, THEREFORE BE IT RESOLVED (1) That the Board specifically finds and hereby determines that the uncontrolled growth of vegetation and/or the refuse and debris on each of the said properties listed above constitutes a nuisance within the meaning of Ohio Revised Code Section 505.87, and the Board Directs that notice of this action be given to owners of the said property and lienholders in the manner required by Ohio Revised Code Section 505.87; and; (2) That the Shawnee Township Board of Trustees hereby orders the owners of said property to remove and abate the nuisances within seven days after notice of this order is given to the owners and lienholders of record, and within four days after notice of this order is given to the owners and lienholders of record for properties previously determined to be a nuisance. If said nuisances are not removed and abated by the said owners, or if no agreement for removal and abatement is reached between the Township and the owners and lienholders of record within four or seven days after notice is given, Shawnee Township shall cause the nuisances to be removed, and the Township shall notify the County Auditor to assess such costs plus administrative expenses to the property tax bills for the said parcel, as provided in Ohio Revised Code Section 505.87. A motion by Mr. Holly to approve of Resolution #61-14 was seconded by Mrs. Seddelmeyer, and the motion carried 2-0. Roll Call: Mr. Belton, absent Mr. Holly, Yes Mrs. Seddelmeyer, Yes DEPARTMENTAL BUSINESS: Fire Department The Monthly Activity Report for the Fire Department for May 2014, submitted by Fire Chief Truesdale, was reviewed by the Board. Mr. Holly motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried 2-0. The report is attached and made part of these minutes. Discussion: • Calls are up. (EMS calls approx. 70%) • Maintenance of flushing hydrants is almost completed. (Residents to run water a few minutes to clear any sediment) • Testing of fire hoses next week. Police Department The Monthly Activity Report for the Police Department for May 2014, as submitted by Police Chief Keith, was reviewed by the Board. Mr. Holly motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried 2-0. The report is attached and made part of these minutes. Discussion: • 700 calls, arrests are up. • Training numbers are up. • Detectives are busy. Road Department The Monthly Activity Report for the Road Department for May 2014, as submitted by Road Supt. Howard Gray, was reviewed by the Board. Mr. Holly motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried 2-0. The report is attached and made part of these minutes. Discussion: • Mowing side ditches, and repairing tiles. Zoning Department The Second Quarter Report, April 1-June 9, 2014, for the Zoning Department, as submitted by Zoning Inspector Jim Hile, was reviewed by the Board. Mr. Holly motioned for approval of the report, Mrs. Seddelmeyer seconded, and the motion carried 2-0. The report is attached and made part of these minutes. Discussion: • Applications and Permits. • Resolution 61-1 -Township can to deal with tall grass issues and begin mowing as of June 1st. • The Shawnee Township Zoning Board of Appeals met on Tuesday, May 6, 2014 @ 10am to hear variance application on behalf of the Allen County Sanitary Engineers Office for permission to construct a pump station at 1680 Ft.
